You must be at least 18 and able to form a binding contract. Keep your credentials confidential; you are responsible for activity on your account. Tell us promptly at care@homegoinghq.com if you suspect unauthorized access.
You own what you upload and create. You grant us a limited license to host, process, display, and transmit your content solely to operate the Services (for example, storing your documents, rendering your program, emailing an invitation you initiate, or publishing a memorial page you choose to publish). You are responsible for having the rights to what you upload — including photos and music references — and for the accuracy of information you enter. Estate members you invite can see and, per their role, edit shared estate content; choose your invitations accordingly.
The Guide and other AI features generate responses automatically. They can be wrong, incomplete, or out of date, and they are general information, never professional advice. Verify anything that matters — particularly deadlines, legal requirements, and financial figures.
Sealed Last Wishes recordings cannot be edited or deleted through the Services once sealed — that permanence is the feature; do not seal content you may want to retract. Whether such a recording has any legal effect depends on your state's law — it is not a will and should not replace one. The Sensitive lock encrypts data on your device with your passphrase; if the passphrase is lost, the data is unrecoverable by anyone, including us.
Publishing a memorial page makes its content public to anyone with the link. You are responsible for what you publish, including photos of others and tribute moderation choices. We may remove public content that violates these Terms or the law.
We respect intellectual-property rights and expect users to do the same. Do not upload photos, music, video, writing, or other material to memorial pages, programs, or any part of the Services unless you own it or have permission to use it.
Reporting infringement. If you believe content on the Services infringes your copyright, send a notice to our Copyright Agent at care@homegoinghq.com (subject line: "DMCA Notice") that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work you claim was infringed; (3) the URL or a description that lets us locate the material; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf.
Removal and counter-notice. We will remove or disable access to material that is the subject of a valid notice and will notify the person who posted it, who may submit a counter-notice if they believe the material was removed in error. We follow the counter-notice process set out in the Digital Millennium Copyright Act (17 U.S.C. § 512).
Repeat infringers. We will, in appropriate circumstances, disable or terminate the accounts of users who repeatedly infringe.
Concierges are independent businesses. A Certified HomegoingHQ Concierge™ has completed our training and holds our private credential, but is not our employee, agent, or partner; their services, prices, and conduct are their own, under their agreement with you. The credential is not a state license, and concierge services are organizational and logistical, not licensed professional services. Funeral home partners are likewise independent businesses. We are not a party to, and are not responsible for, your engagements with professionals — though we want to know about problems: care@homegoinghq.com.
Do not misuse the Services: no unlawful use, no infringing or abusive content, no attempts to breach security or others' estates, no scraping or reselling the Services, no uploading malware, and no use of the platform to give licensed professional advice you are not licensed to give. We may suspend or terminate accounts that violate these Terms, with notice where practicable.
The Services — software, design, content, templates, curriculum, and the HomegoingHQ, Concierge™, and Academy™ names and marks — belong to EdConsult LLC and its licensors. These Terms grant you a personal, non-transferable right to use the Services; they transfer no ownership. Certification grants a personal, revocable right to use the credential name per the credential's rules.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTENT (INCLUDING AI RESPONSES AND GUIDED INFORMATION) IS COMPLETE OR CURRENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDCONSULT LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM THE SERVICES; AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; where they apply, these limits apply to the fullest extent permitted.
You will defend and hold us harmless from claims arising out of your content, your use of the Services in violation of these Terms, or your engagements with independent professionals.
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflicts rules. Disputes will be resolved in the state or federal courts located in Michigan, and you consent to their jurisdiction. Please contact us first — most concerns are resolved with a conversation.
Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and EdConsult LLC regarding the Services and replace any prior agreements on that subject.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our consent; we may assign them to an affiliate or successor (for example, in a merger or sale of the business).
We may update these Terms; meaningful changes will be posted with a new effective date and noted in the app, and continued use constitutes acceptance. You may stop using the Services and request account deletion at any time. Sections that by their nature survive termination (including Sections 10–15) survive.
